An unsecured bail bond is when there is no collateral put up. This occurs when a judge has reason to believe that the defendant will likely show up to trial. When a suspect is granted this type of bail, he/she must sign a document which states that they will pay if they do not come to court. In addition, by failing to show up on their court date, they will also be charged with a failure to appear charge. This charge, however, will be given if the suspect does not show up for their court date, no matter what type of bond they have.
When it comes down to it, the truth is that not many individuals will be spared with an unsecured bail bond. It is too much of a risk that the defendant will not show up in court. However, if an individual has only committed a minor crime, then he/she may be granted this. In addition, when a judge is deciding which type of bond a defendant deserves, they will consider the following:
The age of the defendant
The defendant's past criminal history (how serious were the crimes that were committed)
Whether or not they have failed to appear in court before
Whether or not their release could be a threat to the community
